Who are we?

 

Your data will be processed by Nest@Lisbon, a brand owned by the company Outstanding Nests, Lda., legal entity no. 514568917 (hereinafter referred to as Nest@Lisbon).

 

Nest@Lisbon is the data controller within the meaning of the General Data Protection Regulation (GDPR).

 

Why do we process your information?

 

Your personal data may be collected and processed by Nest@Lisbon for the following purposes:

 

a) To comply with legal obligations to which Nest@Lisbon is subject, namely communications to UCFE (Coordination Unit for Borders and Foreigners), to CML (Lisbon City Council) for tourist tax purposes, and for invoicing.

 

b) For the execution of the Temporary Tourist Accommodation Agreement or the Local Accommodation Management Agreement entered into with Nest@Lisbon, including payment transactions, check-in and check-out management, guest management, provision of additional services such as cleaning, transfers, and compliance with contractual obligations or pre-contractual steps.

 

c) For communication purposes via email, mobile communications, and digital platforms, within the scope of Nest@Lisbon marketing strategies, commercial and contractual communications, as well as information requests.

 

d) For the protection of property owned or managed by Nest@Lisbon, as well as for statistical analysis purposes.

 

Failure to provide personal data for purposes (a) and (b) may result in Nest@Lisbon being unable to comply with its legal obligations and may lead to termination of the accommodation contract or management agreement, without any right to compensation, as well as the inability to provide services properly, for which Nest@Lisbon cannot be held responsible.

 

What types of personal data do we collect?

 

Within the scope of its activity, Nest@Lisbon collects and processes personal data necessary for the provision of contracted services, information requests, or pre-contractual management, namely identification data, contact details, banking details, or payment card information.

 

Legal basis for processing

 

Your personal data is processed based on the performance of the Temporary Tourist Accommodation Agreement, the Local Accommodation Management Agreement, and compliance with legal obligations imposed on Nest@Lisbon, namely legislation on the entry, stay, and exit of foreigners in national territory and tax legislation (Article 6(1)(b) and (c) of the GDPR).

 

Additionally, personal data collected for the purposes described in point (c) above are based on your consent (Article 6(1)(a) of the GDPR).

 

For the purposes described in point (d), data processing is based on Nest@Lisbon’s legitimate interests (Article 6(1)(f) of the GDPR).

 

How long do we keep your information?

 

Unless otherwise required by law, regulation, or judicial decision, personal data will only be retained for the minimum period necessary for the purposes for which it was collected or subsequently processed.

 

With whom may we share your personal data?

 

Nest@Lisbon may need to share some of your personal data with the following recipients:

 

a) Affiliated organisations and/or companies of Nest@Lisbon, provided they comply with equivalent data protection standards.

 

b) Public authorities to whom Nest@Lisbon is legally required to provide information, namely UCFE (Coordination Unit for Borders and Foreigners) and the Tax Authority (DGCI – Directorate-General for Taxes).

 

c) Service providers acting as processors who handle personal data on behalf of Nest@Lisbon under contract and solely for technical support purposes. These include website hosting providers, email marketing services, cleaning companies, law firms, accounting firms, and insurance companies.

 

d) Competent authorities to whom Nest@Lisbon is legally required to disclose information in legal proceedings or for security and technical purposes, such as judicial authorities or data protection authorities.

 

Is your data transferred outside the European Union?

 

Your personal data is not transferred outside the European Union.

 

Exceptionally, under certain conditions and in accordance with applicable law, data may be transferred outside the EU for hosting, storage, technical processing, backup, recovery, or service development purposes.

 

Nest@Lisbon ensures that no data is transferred to countries that do not provide an adequate level of protection under the GDPR.

 

What are your rights?

 

At any time, under the GDPR, you may request access to your personal data, as well as rectification, erasure, restriction of processing, objection to processing, and data portability.

 

If requests are manifestly unfounded or excessive, particularly due to their repetitive nature, Nest@Lisbon may charge a reasonable fee based on administrative costs or refuse to act on the request.

 

Where processing is based on consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal, or processing based on other legal grounds.

 

You also have the right to lodge a complaint with the Portuguese Data Protection Authority (CNPD).

 

Security and confidentiality

 

We are committed to keeping your data secure and apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk.

 

However, data transmission over the internet is not completely secure, and we cannot guarantee absolute security of information transmitted through our website.
